Terms of Service

These terms are the agreement between you and Deehvine Marketing LLC for Deehvine Connect. They describe what you are buying, what happens if you stop paying, and what each of us is responsible for.

1. Who you are contracting with

Deehvine Connect is operated by Deehvine Marketing LLC (“we”, “us”). By creating an account or using the service you agree to these terms. If you are agreeing on behalf of a company, you confirm you are authorised to bind it, and “you” means that company.

2. Your account

You need an account to use the service. Keep your sign-in details to yourself; you are responsible for what happens under your account. We offer two-factor authentication and a list of your active sessions in Settings, and we recommend you use them.

You must be old enough to enter a contract where you live, and you must give us an email address you actually control — it is how we reach you about your plan and how you recover access.

3. What the service is

A physical NFC card, a public profile it resolves to, and the tools around them: themes, links, contact sharing, and depending on your plan, lead capture, analytics, teams and a custom domain. What each plan includes is set out on the pricing page.

The card is yours. You bought a physical object and it remains your property. It is not welded to a profile: where it points is a setting you control, and changing it is never a reprogramming job. A card keeps resolving even if your subscription lapses.

4. Payment, renewal and cancellation

Subscriptions renew automatically at the end of each billing period until you cancel. Payments are taken by Stripe; we never see or store your card number. Prices are in US dollars and exclude any tax we are required to collect.

Some options carry a fixed term — a twelve-month commitment in exchange for a lower rate. Cancelling one of those stops it renewing at the end of the term rather than ending it early.

Cancelling stops the next renewal. Your plan runs to the end of the period you have already paid for, and then stops. We do not refund amounts already paid, and physical cards are not refundable once they have been produced. If something has gone wrong, write to us before you cancel — we would rather fix it.

5. If a payment fails

A failed payment does not switch your card off. Your subscription moves to a grace period during which your card, your public profile and your links keep working exactly as before, and we will tell you what happened and how to fix it. Premium features are restricted only after that grace period passes.

If your plan ends or is downgraded, profiles beyond the new allowance are retired, not deleted: they stop being public, and their content is kept so that resubscribing restores them.

6. Your content, and the people who share theirs

Everything you put on your profile stays yours. You give us permission to host, display and transmit it for the purpose of running the service — nothing more. We do not sell it and we do not use it to train anything.

When somebody shares their contact details through your card, those details are yours to look after, not ours. You are the controller of that data. You decide what you do with it, you are responsible for having a lawful basis to contact them, and you must honour their requests to be removed. We process it on your behalf, as described in the Privacy Policy.

7. What you may not do

  • Impersonate somebody else, or present a business you have no right to represent.
  • Publish anything unlawful, or anything that infringes another person’s rights.
  • Use the contact-sharing form to collect details you then use for spam.
  • Probe, scrape or overload the service, or work around its rate limits and access controls.
  • Resell the service as your own without a written agreement with us.

If you do these things we may suspend or close your account. Where it is reasonable we will warn you first and give you a chance to put it right.

8. Availability

We work to keep the service running and we do not promise it never breaks. We may change features, and when a change removes something you rely on we will give you reasonable notice. Planned maintenance is scheduled to be as boring as possible.

9. Closing your account

You can close your account yourself in Settings. Closing stops your cards resolving immediately and keeps your records, so a change of heart is a conversation rather than an excavation. Closure is refused while you still own a team with other members, have a live subscription, or have a card in production — we tell you all of the reasons at once rather than one per attempt.

A permanent erasure is a separate, staff-run step you can ask us for. It removes profiles, leads, analytics and memberships, returns cards to inventory, and anonymises your sign-in record. Invoices, payments and orders are kept: they are accounting records we are required to hold, not personal data to discard.

10. Liability

The service is provided as it is. To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profits, or lost business opportunities. Where we are liable, our total liability is limited to what you paid us in the twelve months before the claim.

Nothing here limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by negligence.

11. Changes to these terms

We may update these terms. The date at the top changes when the wording does. If a change materially reduces your rights we will tell you before it takes effect, and continuing to use the service afterwards means you accept it.

12. Governing law

These terms are governed by the laws of the State of Rhode Island, without regard to its conflict of law rules. Disputes will be heard in the state or federal courts located in Rhode Island, and we each consent to their jurisdiction.
